I need to talk to a union rep about my termination. I got terminated for writing down that I clocked in at nine instead of ten because I was running late and I had no phone to call the store to let me manager know. I wasnt even scheduled that night to come in but told my manager I would go in because I didnt want to lose any hours because the next day I had a back procedure that wouldnt allow me to work for 24 hrs. I also let my manager know I was gonna leave early because I had to be at the hospital at a certain time in the morning. I dont understand  how I can get fired over and hour?? I need someone to talk to. Who can I talk to??

Writing down that you came in at a time different than when you actually did come in constitutes falsification of company documents, especially when it means you'd be getting pay for time (in your case an hour?) you didn't actually work. If that's actually what you did (it's not too clear from your message, I might be wrong), then I don't think the union could do anything. You could try, but if you don't even know who your union rep is, well, that doesn't bode well.

Sure, it was a simple mistake, but at the same time, another bloke who did that can later claim to have worked an hour earlier than he actually did. And if there's one thing Kroger doesn't like it's union interference and lawsuits about wages, so they're VERY, VERY meticulous about this stuff.

As a courtesy, if I am in a good enough mood, when it is time for me to clock out I will go to my FES and ask if he or she needs anything else. For instance, the other week the FES asked if I would stay an extra 15-20 minutes because we ended up getting busy right when I was supposed to leave. But I know that they won't tell me "Yea, can you stay until..." due to Kroger's extreme take internally on working past your scheduled time. Usually I try to watch for that and when it's time to clock out, I clock out as soon as I can. I have stayed up to 20 minutes past but have never heard anything. I always assume it's due to things like said incident with FES. But I try to ask because that way I am reminding them "Hey, I just worked for you guys, don't forget me" and it trickles down - I'm the one that usually gets a call asking me if I can work when it's my day off, or asked if I can work a few hours later a day or two later when I work again. Things like that.

If I've had a crappier day -- and it's Kroger, and I'm a courtesy clerk, so it happens often -- I'll usually just go up to the FES first chance I get and say "See you tomorrow" or "See you later," something like that, and go clock out. that way if any crap hits the fan, I know I had their acknowledgement that it was time for me to clock out. 

It's a slippery slope and I hate playing politics like that but these are the same FESes that frequently forget to ask me if I want / need / it's time for a break. Many, many times I have had to request one after working several hours straight. So I figure, meh, what makes the world go around, you know? It's not like I am doing anything that could get me into trouble. The schedule says it, you go by the schedule. If they ask me to stay later, and a manager questions it, it's not my fault, it's Front End's.

Of course, FES can ask you to stay until so and so, but only if they ask.


If your FES is on top of things, he'll remember he asked you to stay and will be reflected on your paycheck the following week.


My FES would ask me to stay beyond my schedule because 1. I asked if I could; 2. Because they really need the help. One day he told me that he won't be asking any time soon because they (management) got on to him about letting people stay longer.


It can't be helped and it wasn't his fault. They schedule people like four hour shifts and want them out the door right after, but still want eight hours' worth of work done.

Anyway, back to the OP's point. Whether it was an accident or not, it technically is "falsifying" company record and can also be considered stealing time.



I recall that some hiring managers forgot to cross their T's and dot their I's, as a result, a chunk of our employees either had to provide proof of residency status or a work permit within four days, or be forced to leave. Many of them have been with the company for years and even my store manager was on the list. However, when they transferred records from paper to digital, they noticed those I's and T's not being properly marked.

Ok, you have no recourse except to file for unemployment and find a new job if you purposely wrote down 9 instead of 10.  Kroger will fight and probably win the unemployment.

A good union rep could try and argue that you were stressed about the surgery.  The store level union rep can't help you.  You need to contact the district rep.  I do not think you have a chance but you can try.  I have seen people return after worse things.

Your post makes it sound like you purposely wrote down 9 instead of 10.  You will get no sympathy from me if that is the case.  Stealing an hour is stealing an hour.  If you did that, what else will you steal?

My sister fired a worker for doing the same thing over 30 minutes.  The fired girl was like, "What's the big deal?"  The deal is that it is stealing.

you put down an hour too early...  that's strange and why you didn't write it down when you came in instead of trying to remember it hours later i don't understand.  

some stores don't use these ring error sheets and require you to get an override.  

you probably could have just left the time blank if you weren't sure, they would've found you in the kronos system.

Sorry brother, but not even the union can help you on this one. You could try and claim you weren't sound in mind due to your medications.

He probobly tried to clock in at 10 then put on the sheet that he clocked in at nine. The time and attendance person saw in Kronos that he clocked in at 10 reviewed the tapes to see him come in at ten. Moral of the story be careful if you try to cheat the system its not hard to fiqure it out with technology.

You don't have a chance in hell of winning this. You got caught falsifying documents, and the company was well within it's rights to fire you. Good luck in your new job.
