I work in Produce and we just had a full timer retire and the position was vacated, I have 5 years pt seniority (I think the third highest in the store) and our store manager gave a favorite with only 1 year seniority full time because "We lost some of the bids for this position." His availability isn't open either, he will only work 1-930 on the weekdays and mornings on weekends and they claim they can accommodate him. I'm pretty sure most divisions require unrestricted availability and he most certainly shouldn't be full time after just one year of service, I should be the successful bidder. Is it worth grieving, and if so, how long can the process take?
Damn right it's grievance able. I'd go over your store level union stewards head for this one too. He's probably in on it. Unless you're pretty good friends with him/her. it's completely unethical for a 1yr associate to get full time over someone with 5 years experience. With everything else being equal.

If they had truly "lost some of the bids" they would have had everyone re-submit their bid for the position. The manager should be fired. It's basically a form of stealing: taking the title and the money away from the person who's entitled to it and giving it to someone who's not.
Just be prepared if you do win. The manager has already picked his favorite. If he has to be proven wrong and give you the position, he could make your life a living hell. They did it to me. They kept saying "we have to offer you this position, but we really want "Becky". Don't take it if you really really don't want it. I kept saying yes, I do want it. So I got it and they flat refused to train me, yelled at me, left me alone without training. "Becky glared at me all day every day and let me know how unhappy she was. Plus "Becky" got some of the other employees to be mean to me. I put up with it for two weeks and said enough, "Becky" can have it. Then "Becky" gave me this bitchy "I won" smile every time I saw her. Kroger management sucks. If you make them go by the contract THEY SIGNED they don't like it.
I hope you do file a grievance against them and win. Just be prepared. I hope they don't give you any trouble, not all stores or managers are alike. I would just be as understanding and friendly as I could and explain that you did want the position and you understand they probably didn't know since the bids were lost, but you are willing to overlook that and start your new position immediately lol!
