I've yet to see this rule in writing personally, but some of the employees saw it on a desk upstairs one day.  It was for the front end only apparently and said that if anyone had to use the loo, they'd have to take their break to do so.  I don't think they can do this but with all these whacky new rules they're trying to enforce I don't really put anything past them.

 

I'd **** or piss my pants before I clocked out for a break to go relieve myself.  Then I'd take my soiled self home for the day, leaving them to find a replacement.  They should think twice before posting this rule!

When rules like this are set up they are usually trying to get people to quit. Happens everywhere in the New Non-Economy.

Yeah...sorry, but that ain't gonna fly. Especially for women with periods. So, you're just gonna let em bleed on the floor? Pretty sure that's a health hazard.

I don't like it when people (and by people I mean half the front end, not surprised they were the department targeted...) take their break, clock back in, then head promptly to the restroom for ten more minutes. You just had a break, use it!

But that said, this is a stupid rule and it's no surprise that it hasn't been put in writing, I bet the union will tear it to shreds the moment it does. The most we've done in our store is ask certain people to leave their phones behind before they go to the restroom, and even that is completely unofficial.

And yea, wouldn't be surprised if someone sued for sex discrimination (women), age discrimination (older people), or violating disability laws.

Yeah there's someone i know (not front end) that has to use the bathroom more frequently than average due to some medical issues. It's nothing that she is considered disabled for but is just a huge inconvenience for her... i'm pretty sure if they tried that with her she'd just tell them to f**k off and she'd quit.

Check the wording in your union contract about breaks.  Our says that breaks have to be given after the 4th hour and before the 6th hour (if you work an 8 hour shift).

 

Let's say you are schedule from 10 to 6.  At 10:15 you have to pee.  They make you take a break.  So you are supposed to work the rest of the day, over 7 hours with no break?

You need to turn this into a positive!  Kroger is famous for making cashiers wait forever to take a break.  Sometimes they give you a break at the end of your shift!  Now you can pick when you want to take a break (providing you have a strong bladder and can hold it).  Want a break at 1:00?  Then you have to go to the bathroom!  Now, if Kroger says you cannot go to the restroom when you "need" to, then you may have grounds for a lawsuit.

 

Pee before you clock in, before you go back from break and you should be ok.  Somtimes you may have to go another time but it shouldn't really be a habit.  Twist this around to your advantage!

Pretty sure that's bull****. Like it's one thing if you're disappearing every other half hour to go the bathroom, but if you gotta go, you gotta go. Call your union and let them know.

I'm so glad I don't work on the front end, though. I go the bathroom and take my breaks whenever I want. I have a tiny bladder, man, I ain't waiting for nobody.

most of the time when i get my break i'm hungry as hell and i don't want to waste part of my precious 15 minutes on the bathroom when i already gotta run around the store to get food and wait in line to check out

 

anyway you can't schedule your bodily functions lmao, just raise holy hell with the union, they'll drop it

 If you are working few enough hours to get only a 15 minute break then you can eat before or after you get off work.  People like you are why they are trying to enforce this new rule.  You can buy food and drink before your shift starts, put it in the break room.  When your break starts, go to the bathroom then eat or eat and then go to the bathroom.  It's not that hard to plan.  Use your brain and find a solution, don't just expect everyone to go along with the way you want it to be.

At SW327 the front people are always MIA there is always a manager or two up there checking. Also people will get called from other departments. However I have never heard of that rule though.

 I'm pretty sure OP was saying they had to clock out to use the restroom, do it on break.  I didn't read anything where OP said that Kroger is making them wait an unusual amount of time to go.

 Oh, ok.  It wasn't OP you were referring to.  You were referring to the post where they had access to a bathroom but chose not to use it so they could eat and drink instead.  I don't think Kroger was violating federal law lol!  Good try though, trying to twist it all around.

I found out exactly what it was about:  apparently they don't want employees clocking back in from break, stopping at the bathroom on their way back and being gone for more than the usual 15 minutes.  It messes with their "scheduled" break times or something

That's just the way Kroger is.  Obsessed with minutes!  We never clock out for breaks or lunch.  The only time they ask us to clock out is if we leave the premises (parking lot).  They never complain if you work 7 minutes over but OMG, if it's about to hit 8 minutes here comes the lecture!
