What gives them the right?

 hmm  There is a person in my department that does as little as possible. When they do do something they make a mess and don't clean it up. Messes bother me. We all have to take the food safety test before we are hired. We all know about cross contamination. This person use to be a Lead but gave that up and is now as equal as the rest of us. I will spend my time between customers and other duties cleaning up (Ding Dong it's Friendly and Fresh time). I will say something, to them, if I see them slicing something other than meat on the meat slicer. When I do, they threaten our Lead with leaving for the day, Union, etc. First of all you are unable to file a grievance against another Union member. Second You're not allowed to threaten anyone in the work place. If I were to threaten the Lead like that management and the Lead would say to me "If you make that choice then you have decided to quit. Don't bother returning." then write me up. My Lead won't do this. They just listen and sugar coat it to calm the employee down. My Lead hasn't told me I'm doing anything wrong, but isn't saying anything to the other one either. I don't care how long you've worked for a company, you don't threaten your boss and you do your job. So, what gives this person the right to do this? Why does the Lead and management allow it? What kind of hold can any employee have on a company that allows them to to treat their Leads that way?

You answered your own question -

they're in the union, they've worked there a long time, probably have GOOD union benefits on an old contract. Management isn't going to go through the trouble of firing an employee that won't go out quietly.

That's wrong! That is disrespectful! I wouldn't use the Union in that way. The Union is there to protect those who want to do their job and do it well. The Union is there to keep management from taking the wrong steps to fire someone, just because they don't like them or disagree with their way of thinking. If you are threatening others, not doing your job right, and risking the health of the customers, you are a risk to the company and the Union. If neither are willing to put a stop to it and willing to ignore the Food Safety laws just to support that one person, they shouldn't be in business.

My department had our own version of a sorry Kroger lifer who crow about the Union, how they were a big shot in the Union, and bully co-workers and customer alike. It got so bad that they would move departments breifly but it never lasted because they weren't productive enough, being old and out of shape.

Well, one day after 30 years with Kroger, they were fired. They tried to sic the Union on the management one last time, in a desperate attempt to save themselves, but it was a bridge too far. And no, it wasn't even theft-related. That's how many writeups and SIRs this person piled up, and just relied on the Union to bail them out.

Eventually, that day may come for your co-worker.

They don't have the right! All Union members are equal. They only have seniority when it comes to hours, days they request off, and higher positions available. They have no right to threaten another Union member or their Leads.
