Question about filing a grievance re: Back Up Pay
Permalink

In late June of 2017, my Front End Manager asked me to be his back up. I said yes, and he immediately contacted our Front End coordinator to get the process going. Every couple weeks he would ask if they had the paperwork for me to do the training and was always told that they were working on it. Meanwhile, everyone (including management) acknowledged that I was in fact the back up and did everything (and more) that the back up should do. Scheduling, covering FEM vacations, supply ordering, dealing with nonsense, etc. After about 4 months I asked my admin manager about my pay. She hadnt given me my 40 cent premium that I was suppose to get as the back up. She fixed that for me and I got paid retro since June.

Keep in mind at this point I was still not certified. Finally in February 2018 I got the paperwork and was just certified this week. Do I have a case to file a grievance to get retro pay for the raise that Im about to finally get? Back up pay in my division is 16 and change. Its about a $5 raise for me. Months and months of doing all the back up work, and being delayed certification due to no fault of my own. And also having being acknowledged on my pay stub as getting that 40 cent premium since June.

What do you think? Do I have a case? Im going to talk to my union steward next week.

Why was it 40 cents? Technically they will say, certification is when they determine to test you I'm guessing. Unless, you have all your ducks in a row to prove you were qualified and proof you where told this multiple times, I cant seem them paying this amount of $$ out.

You are not entitled to retro pay after completing all the training to become a certified backup. This is why it's so important for people to get their certification completed early, otherwise, they're missing out on $6+/hr pay raise sometimes.

If I understand your question correctly, you are asking if you should get retro pay back for all the time you spent in "training" to become certified. No, you don't. You only start getting paid the correct amount once the training is complete which can take up to a year. You do get relief pay, however, when the department head is on vacation, whether you're certified or not.

This happens to a lot of people. Particularly people who do not put pressure on management to get their stuff together. I had to sit down with my store manager and another manager before completing my final step of certification because it was already 5 months too long and I should have been certified 2 months earlier except I had not because my department head was refusing to train me on schedules and management delayed getting me my proper paperwork. I had put in for other stores so they would get the message that I was serious. Unfortunately, nothing we can do except let other backups in training know that they HAVE to get the ball rolling because otherwise nobody cares.

If you have completed the tests and were told you were Back-up, but still didn't receive the raise, contat your local Union office and ask them about it.
