Ok at the store I work at they have told me that because I have restricted my scheduling giving me 3 days off a week that basically they can schedule me however they see fit.

I have worked there for 3+ years and there is a full page of people below me in seniority

There are people who have also restricted scheduling below me in seniority that come in and leave before I do.

I do not see how this is possible.  I have always believed that regardless of however you may have restricted yourself your seniority should hold strong on receiving the better shifts then people below you

So what should I do? I have asked my A.C.S.Ms and they have told me they are not too sure its just what they believe

Should I call my union rep? is what they are doing even legit? any insight to this would be greatly appreciated...

If you do have more seniority than those who get the better shifts, you can always "bump" them. If you see a shift for the next work week on a day that you are available to work that's taken by someone with less seniority than you, simply put in a request to bump their shift. You must do so within a given time frame. At my store, schedules are posted on Thursday at 12pm and bump requests must be submitted before Friday. So check the updated schedule immediately for the next work week and make your requests. Keep in mind though, a request is simply that. It does not guarantee anything, but if the person you do decide to bump has no scheduling conflicts for that day (school, etc..) then it is mandated that you receive the shift you requested.

Just wanted to add that you should also contact your union representative, store manager and department manager about the scheduling. They "should" work with you the best that they can. Scheduling isn't as easy as some think, and keep in mind that it is difficult for managers to take everyone's scheduling concerns into consideration while at the same time getting the help that they need.

By union contract, claims against the work schedule will be submitted in writting and initialed by a memeber of management prior to 3pm Saturday. I do not understand how any particular store can circumvent this even if they post the schedule earlier than Friday 3pm.

Regardless, before claiming anyone's hours I firmly believe you should try any and all other options first.

AS far as restriction of your hours, this is not covered in the union contract. I just want to state that I believe any and all employees should be available during normal store hours and can be scheduled accordingly. Now if your management team allows these restrictions, that is soley up to them and it should not affect your senority. They may say however "well we are no longer accepting restrictions".

At our store the "favorites" get the good hours regardless of senority. A lower person that sucks up or went to the right high school will get better shifts. They do this in a way you can't bump it. For example, a person below me could work 7:00am - 2:45 pm and I could work 4-12. I could not bump that shift because I can't bump for less hours.

seniorty doesn't matter anywhere it seems like, they are going to schedule however they want too. but if you request certain days off because you cannot work them then the people under you are going to get moire hours than you get, regardless of how much seniorty you have over them.  unrestrict your hours and then you will see that the person making the schedule will bring your hours up.  but if you talk to the union about your seniorty and then you tell them that your hours are limited they will just laugh at you, because you are complaining about not getting any hoiurs when you told them that you cannot work on certain days.  i've been with kroger, next month will be 4 years and right now i'm getting 40 hours a week for like the past 3-4 weeks now.  might i add that i'm only part time also.  with no restricted hours.  so if you have no restricted days off then your hours will more than likely be brought up.

Seniority is set for scheduling hours in out local. Now the contract does not have anything about restrictions. Only thing is that if you restrict your schedule, then you are not guaranteed full time hours or even set times or hours. Only thing is that you are to get the same, if not more, hours than anyone below you on seniority , providing you can go the same job. Also there is Shop seniority also for vacations. That would prevent a person with 3 year service and a vacation set, from getting bumped from some one with more years ( say 20 ) that transfers to your market. That will then change in the first of every year where the 20 year person will then come before the 3 year person..

our schedules are to be submitted to management on Wednesday and no later that Thursday,noon. At noon, Friday, It becomes final and can not be changed without it being done in witting and approved be everyone that it involves.If management wants to change it they can but will have to pay the time that anyone looses or for time someone can not work from a change after noon on Fridays.

As far as i know the union can not help with getting better shifts, only more hours. If your sch is resricted because of school they have to work with you. But it usually stops your from taking someone elses shift unless they have more hours than you and you have senoirity.                                    Mid-South

Two things here. seniority counts in our marker ( local540 in Dallas) but you have to be qualified to do the job. A clerk in not going to be able t bump a less seniority member ( lets say to cut meat) if they are unable to do the job and everything that is counted on for that position.


Second point and I could be wrong on this one. AsI was always told, you have to bump the entire schedual of the one you want to change and not just one day or one day fron person A and another day from person B. Never seen anyone successfully get a new schedual by wanting just one day changed or several days fron several people.
