I don't have a copy of the union contract around. So can someone please help me with this? Can the grocery manager MAKE the crew go on break when he says to?
You should take your break half way into your shift, but if you're working nights- you need to take it before the store closes. At my store they entire night crew goes on break on the same time. If the grocery manager is off, a few will wait until later in the night to take a break- but they make their purchases before the store closes.

which is why i would not work those departments... i'm in grocery and on an 8 hour shift, i take my first break at least 3 hours into the shift, then lunch a couple hours later, then break...when i come back from the last break, i usually have <1 hour remaining. feels good man
Do you guys take 1 or 2 breaks on a 6 hour shift? Our associate manager had told several people they could take 2, but later she realized that you only got one...so some people still take 2 lol
It probably depends on your union. But if it's a six hour shift or less, you can't be made to take a break or lunch.

I don't take one unless I work 8 or more hours. If I work 7½, I won't bother with it.
i cannot understand people who don't take their breaks. Wait, are you in the fuel center? If so then maybe I understand, but any department that requires you to be standing all day I could not see how you could pass a break up!
Section 8 of local 540 contract in Dallas meat departments.
Employees shall be granted two (2) fifteen (15) minute rest periods, with pay, each day; one (1) rest period to be taken in the shift worked prior to lunch and one to be taken in the shift worked after the lunch period.
Section 9
If an employee works more than ten (10) hours in any one-day, a third (3rd ) fifteen (15) minute rest period shall be granted.
Section 2
No employee shall work more that five (5) hours without a lunch period. Lunch periods shall be no less that (30) thirty minutes and no more that sixty (60) minutes in duration unless mutually agreed between the manager, employee and the union.
Now there is no-where in this contract that states a break for just a shift of 5 hours or less. But there is the common practice of one 15 minute break. Most of us in the market usually does not take a lunch but just takes the two breaks together and eats in the store. The lunch is not denied and can be taken when and if they want to.
I can say that our night crew generally takes their break together and will not take it with the Grocery manager. They just do not like her.

I guess there are differences in our contracts. I don't know mine word for word, but I know that it says that we shall be granted one 15 minute break for every 4 hours of work. Also I believe it says that we shall be granted a third 15 minute break for anything over 8 hours.

Yes, I'm in fuel. I just don't bother with a break. Well, I won't clock out for a break, at least. I'll occasionally go outside, or sit in the back for a bit. But when I'm standing or sitting inside of the fuel center 75% of my shift, I just won't bother. The other 25% requires me cleaning, helping customers, or other misc. tasks.
I worked kitchen 2nd shift. my unit manager controlled weather ii got a break or not, and when. normally she made me wait untill 8:30. if i went early, i got wrote up. some days, she told me i couldn't even take a full 30, because "there is too much to do, for you to hide in a corner and read novels' she hated me reading

If this is a problem then contact your union rep and file a grievance. We have a store director that decided that there would be no-breaks during prime time selling and that meant there would be a number of people. all part timers, that would not get breaks at all. Sent an email to the local union rep and they came out and files a grievance on behalf of 32 violations. Store director just left it alone and they came back out and filed again adding another 30 violations. By the time it got to HR it cost the Store director 78 violations or 19.5 hours of back pay to those involved and a reprimand in his file.Now everyone gets there break regardless of how busy it is .
wow grumpy i didnt relized that you did that. im glad you did though the no breaks in prime time was hard on our crews, even in the meat market. i just couldnt understand if i or someone was there to help the customer then why couldnt we let other members of our team go on break.
