As I was ringing up groceries, I kept noticing a flash from the next customer in line. I didnt want to look but I turned my head quickly and saw her holding her cell phone. Then there was another flash and a shutter sound this time. I definitely think she took a picture of me but dont know why. She was friendly or what not. Is this legal? Can some random person take your photo without your consent? I dont want to be photo'd and find my photo floating around online. I dont even have any social media websites simply because I dont like photos and social media period
Policy is no photography without store manager's OK. We had a jackass videoing us tonight with his cell phone and I put a stop to it. It was freaking out my cashiers. I had a woman video me while I checked out her order one night.
It's not illegal, no. In theory a customer could be thrown out for doing that, but what manager is going to do that unless the customer is seriously harassing an employee?
Let your manager know and see how long someone is videoing or taking pictures of employees. My guess? Not too freaking long. People are weird.

I had my photo taken by a customer. She asked me if she could. It was because of the Taste of Mexico shirt.
In retrospect, I should have declined, but it was a short break that technically involved customer service, so. Worth it? I guess, until I wind up seeing that photo again, along with a blackmail letter.

You'd be surprised. My cashiers had asked that guy videoing to stop. He was filming the young cashier in his lane as she rang up customers ahead of him. He was a total creep.
I've seen people in store filming their shopping trip and you can even find a few of those on youtube. But when someone says NO, you better stop.
It depends on your jurisdiction. If you live in a "two party consent" state, then you can theoretically press wiretapping charges against anybody who takes a photo, video recording, or audio recording of you without your knowledge and/or consent. If you live in a "one party consent" state, then nothing can legally be done to the customer, but you can always inform a manager.

Just explain to the photographer that you do not give your permission for use of your image in any "for profit" (read; YouTube, other social media) video or still photograph production. A model release needs to be obtained before using your image. Also explain that if you do find out your image is being used that person will be working for you the rest of their life. And, follow through if you find your image anywhere.

Customers are in a private business and cameras and photos are not allowed. This is why when news crews show up they're to be on the sidewalks unless approved. Every time I see a customer recording or photographing the place I request them to put away their phone or leave. If a customer posts your image on the web without your permission you can sue because they did not post it with your consent. One of my high school class mates sued her teacher because he did not get her permission to use a picture of her in a slide show and it was making fun of her. She sued and got some compensation from the school. This store actually made the news in my area abt 10 yrs ago.
About 6 months ago someone from Corporate was filming our cashiers and front end people (for the corporate web site?) I told him he did not have a signed model release from me to take my images. I have had problems in the past with stolen headshots and I now copyright all my voice and photo mtterial. He got a bit pissy but dod stop
