Bagger lot shift

I was hired at my local Kroger about a month ago and I've been working the past two weeks as a bagger. At my store baggers get 30 minute lot shifts. I usually work about 4 hours and I end up scheduled for 3 lot shifts per day. I struggle at pushing in carts (I'm only able to do about 5 at a time) and after work I'm left in pain due to arthritis. I don't mind bagging but lot is really a pain. I haven't complained to one of my managers yet but I'm planning on bringing on a doctors not explaining that I cannot do lot because of my condition. Will this upset my managers and coworkers? Will I be fired of scheduled less (I only get about 17 hours per week currently)? Will I be moved to a different position? Does anyone have any experience like this or advice?

If your pulled from lot duty, don't be surprised if they put you on gobacks doing more than your share, constant bagging, more sweeps etc. And how do you handle it if a customer has an overflowing cart of groceries that needs to be taken to their car and the do NOT help? And don't forget the overflowing cart of go backs that you can and will encounter at some point. By overflowing cart, I mean if you so much as sigh, go backs start "falling out" of the cart.

I would be able to handle an overflowing cart. My problem is repeatedly pushing in carts and walking around for half an hour.

just find a different job.  when you got the job they gave you a description on what you are suppose to do. if you physically cant do the one thing they ask you, find a different job. almost every job at kroger is physical even cashiers have to physically lift heavy items and need to move fast.

So, you've been there three weeks? So, still on probation period.

Meaning they could fire you for any reason, including no reason, and they probably will. You can see how little compassion you get from people like Lord_Uboat. If I were you I'd bring in that doctor's note after your probation period is up... and in the meantime don't kill yourself out there on the lot. It's not worth ****ing up your body just for this ****ty job. Walk slower, push less than 5 carts at a time, make sure to greet every customer you happen to see (customer conversations are the best excuse to not do work. Customer service FTW!)

when you were hired you agreed that you could do physically do the job.  clearly you can't and should be looking for something less physically demanding.  

at my store we rarely have more than two scheduled at a time so the other person would be stuck on the lot for the entire shift.  you're in probation, it's too much drama and no return... the job you were hired to do won't be getting done by you so I'd let you go to make room for someone else.

Outside of probation, they can't fire you on account of physically unable to do the job, as it'd be considered discrimination, and since Kroger is EOO regardless of age, gender, sexual preference, religion, and disability, they can get in deep doo-doo.

I do hyave to echo here that if you can get something outside of Kroger that isn't as physically demanding, then do so. I went into the company with a bad back, which only got worse (along with tendinitis of the foot).

What world are you living in?  If you cannot physically do a job you shouldn't have it, and yes you can be fired.  You have to mention it on your job application.  They have specific requirements for each position, such as must be able to lift 50 pounds, must be able to stand on feet for 4 hours, etc. So yes, you can be fired for not being able to perform your job.  The case with OP sounds like they were hired for a different position, it didn't work out so the demoted her/him to a bagger.

Sophie, what job were you originally hired for?  Why were you moved to courtesy clerk after two weeks? why were you not able to perform the job you were originally hired for?  Did you tell the truth during you job interview about your job skills and what you physically could or could not do?  It sounds to me like Kroger is trying to get you to quit.

They can't not hire (or fire if out of probation) on basis of disability if they know about it.   They have to find proper accommodations for the disabled person.

 

Thing is, when people are desperate for a job, they'll leave that part out just so they have some chance, especially if it's a mental health disability due to stigma.  I have an anxiety disorder and I don't disclose that information (anymore) for that reason.  Even though it's illegal, they still try to find that as an excuse to not hire someone.

 

Is it possible that they moved her from another department due to it? Yes, but if they have knowledge of the disability, and if they value her working there, then they would try everything they can to keep her around.

Something about that doesn't seem right, i know they can't discriminate against disabled people, but if you don't disclose it on the application, you're lying about being able to perform the tasks of the job.

If you can't do the job, they really do need to pick someone who can do it.

There's a guy who works at our local Lowe's store who is in a wheelchair. Since he assists customers in finding things, he does his job well. But there's no way they could send him out to get carts. But in his case, they knew when he applied. He wasn't hiding his disability, so they hired him for that position.

I'm not sure how that works, do they need to accomodate someone who shouldn't have been hired for that position in the first place?

Excuse me?  I will not look it up.  You weren't clear in your post so I called you out on it.  If you want to lie about your disability fine, but don't suggest others do it and expect to be fired if you can't do your job because of it.  I can't believe you think you can lie about social anxiety disorder or panic attacks and then just cruise on through your work day!  If you can't do the job don't apply for it.  You've stated before you can't really work around people but yet you expect to have a job and keep it whether you can do the work or not. You're just dishonest and think you are entitled to whatever it is you think you want.

 Struggle sounds like someone who's been playing the game awhile.  She probably slammed on her brakes and made someone hit her from behind.  That's where her "back ache" started.  Just lie on you job application, get the job, then think they can't ever fire you if you are disabled for whatever reason.  Lying scammer is what she is.

Ok.  I have one leg.  I'm applying for a job as a lifeguard.  They have to hire me and find proper accommodations for me.  Lower the lifeguard chair, I can't climb.  Put another lifeguard on duty to watch the kids - I can't really swim out to get them if they are drowning.  I would also probably require an assistant to help me get in and out of my speedo.  Those locker room floors get wet and slippery and I don't balance well on one leg.

 

You win struggle.  You are so right.  Sorry any of us ever doubted you.  And believe it or not, we know what the ADA is, you're not the only one.  We don't have to look it up.  But I bet you have it memorized.  Good for you.

If you are a bagger, a doctors note isn't going to get you out of working carts.  That's the job.  Bagging and carts.  Any other job at Kroger is a promotion and you won't get that either.  What position were you originally hired for?  Because if it was bagger you knew when you took the job what the work was and that you couldn't do it.  If it was another position you were hired for, why aren't you doing it?  Why are you a bagger after two weeks?   If you were honest when you were hired, then you may have a case if you told them "I can't to a lot of physical work because of my arthritis, would this position require that?"  If management knew you were not able to perform that job because of your arthritis and purposely put you into a job you couldn't do then you have a case.  But I doubt it.

ADA is very real, but I can't think of any lawyer who would pick up the case unless you have extensive documentation of a disability, which, by the way, should have been disclosed either during hiring or when it was medically confirmed. And if you do end up winning, it better be a large sum of money, because the last person a company wants to hire is a lawsuit risk.

I ain't gonna even bother with that troll who clearly has never had to deal with discrimination of any kind. Like I said, it has happened to where I disclosed my disability, and it was used against me in hiring, which shouldn't happen, but it does. It is what it is.

Honestly, do what you can't and don't shirk your duties. I'm at a big store and we are on lot for an hour at a time so 30 minutes doesn't seem that bad to me. Use the strap/lease and pull from the back of the lot forward. Fewer carts (depending on the area) and you'll take longer to get back there so you won't be pushing as many loads in. If nothing else, organize the buggies some so the next person doesn't have to untangle the messes that customers leave us.

Former manager here. This guy can get fired possibly, because during the interview and hiring process, he was shown the job description and was asked "Are you able to complete these essential functions of the job with or without reasonable accommodations?" If they want to get real literal, the guy lied on his interview/new hire paperwork, a fireable offense. Now for any accomodtions, the business gets to decide, for the most part, what is and isn't reasonable. If they decide having a bagger that isn't able to do carts isn't reasonable during the hiring process, then they can either A) not hire them (and it's not discrimination) or B) put them in a different job. That simple.

Now, will he get fired if he brings in a doctor's note? Probably not, simply because the company doesn't want to take the chance that the guy is going to get litigious. They'll just make his life a living hell until he quits by restricting hours, ****ty jobs, you name it. Been there, done that, have the t-shirt. It's super effective at getting rid of "dead weight", or at least it's been the times that I've done it.

Pretty interesting landscape it's become for employers/management these days.....

There's a legal advice radio show called Handel on the Law; the lawyer, Bill Handel, described the case of a Muslim guy who caused a lot of commotion at a grocery retailer he worked for. They started him off working meat department----¨oh no no no, you have pork in there!!¨. Ok, don't wanna get Mohammed upset, soooo.........go stock grocery. ¨oh no no no, ALCOHOL in there!!!!

¨ FINE, GO TO PHARMACY.

¨Noooo, there are condoms and aphrodesiacs sold there!¨

So now this guy has taken them to court because, in the store's frenzied attempts to preserve his religious freedoms, they put his ass out in the lot to push carts. And now he's developed physical restrictions.

You know..........sometimes you just need to shut the hell up and either do the work or go home.

You got called out for lying.  So name call if you want to, but you in fact did admit to lying.  So whatever.  Sue the people who didn't hire you.
