UNION WAGES?, Broken Equipment? and a Union Steward sleeping with an employee in West Virginia
Permalink

HOW can Kroger's force employees to pay union dues and they dont pay a union wage?

Krogers at East Point in Clarksburg West Virginia has a Broken piece of equipment that actually KILLED an employee that has not been repaired and they still force employees to use this!

A Union Steward of 25 years sleeping with a 20 some year old employee (that has no problem using very crass language, and propositioning older men, including ones other than the Steward she is currently in a relationship with, AND says cute little things like "Isn't it funny that even though I'm the one being inappropriate, I can tell management you are harassing me, and you will get fired because I'm a girl.") wildly possessive, insecure and jealous, sits out in the parking lot, glares at other men.

IF you take a grievance to Management, they will snicker and roll their eyes, write little notes on note pads and giggle to each other. I don't know about all other Kroger's but that one... it's a JOKE! Do yourself a favor and look.

And just in case anyone from that branch is reading this? Not only is this insanity being reported to corporate... I went right to AFL-CIO!

OH and one other thing...
The person that reported this information to management said "I wish I had a tape recorder on me." He was told it was illegal.

Got a little info for them.

West Virginia is one of the 38 ONE PARTY CONSENT states. Which means...

Although you can not legally record a conversation of two or more individuals speaking in which you are not involved in (for example, like bugging someone without their knowledge or permission)...

YOU CAN in fact legally record a conversation in which you are involved in (as you would be the one party that is giving consent) AND it is also permissible as evidence in court.

SOOO Moral of the story is, don't say inappropriate things to people. Or anything that you aren't going to admit to later if someone asks you about it. You never know who might have a recording device on them and might just play the words you are denying right back to you.

Krogers . . .

How many?

. . . at East Point in Clarksburg West Virginia has a Broken piece of equipment that actually KILLED an employee . . .

Name?

Month and/or year?

Federal law requires the company to report a fatality within eight hours of the occurrence.

. . . has not been repaired, and they still force employees to use this!

Workers' Right to Refuse Dangerous Work

Your right to refuse to do a task is protected if all of the following conditions are met:

  • Where possible, you have asked the employer to eliminate the danger, and the employer failed to do so; and
  • You refused to work in "good faith." This means that you must genuinely believe that an imminent danger exists; and
  • A reasonable person would agree that there is a real danger of death or serious injury; and
  • There isn't enough time, due to the urgency of the hazard, to get it corrected through regular enforcement channels, such as requesting an OSHA inspection.

Moral of the story is... Don't move to West Virginia.

Kroger management doesn't handle grievances, those are handled by your union.  If you are in West Virginia and they just passed Right to Work, then you can opt out of being in the union if you want.  Of course they can fire you anytime they want to for any reason they want to.  But you will save your $6 bucks or so a week in union dues for the peace of mind of knowing every day could be your last. (Sarcasm)
