terminated for not clocking a break.

Ihad worked for kroger from 2001- dec 2015. I had taken a break and needed to run my fiance home so i could have the car.i was in such a hurry that i totally forgot to clock it. Before I had left for the day i had told the assistant manager what had happened. she had told me dont worry about it and it she would have it put into the computer. i was off that next day but when i did come back on my next scheduled shift i was "indefinetly suspended". they have appealed my unemployment saying i was discharged for being absent. i never received anything saying that id been fired.  i feel i was lied to. yes i may have not clocked out but it truly was a mistake that i was thought to be taken care of.They have me on camera going to the restroom several times that day also but they all know ive got stomach problems also. i will be appealing their decision. does anyone else think this was fair reason for the punishment?

Doesn't sound fair.  They could try saying you were stealing time, but you did tell them you forgot to clock out.  Have you had problems with them in the past?  Just wondering if they were looking for a reason to get rid of you.  This sounds totally unfair to me, I've done it, we've all probably done it.  I can't tell you how many calls I've had on the day they do payroll wanting to know what time I left last night lol!  That's really not Kroger's policy, it your crazy unfair manager doing it.  I can't believe they would fire your because you FORGOT something and reported it.  File a grievance with the union, get reinstated and get some back pay. They were out to get you,plain and simple. Seen it a million times. Once that kill switch is engaged there is nothing you can do about it, cuz you can't watch your back 100%. I've seen it where cases were literally manufactured just to bring some one down, like the thinking got to "Jesus, just somebody come up with SOMETHING< we'll worry about the details later."

This is one of those things where even if you some how fight it and get your job back, it will be inside 6 months when they come after you for something else that you CAN'T come back from. Seen that too. 

I would review things and figure out where I might have gone wrong there before applying somewhere else.

Stomach problem..i know the feeling. Just bring up you were terminated for a disability and they will be throwing checks at you.

Bring in your doctors notes stating you have stomach problems plus any meds that cause you to use the restroom frequently. Also state that you honestly forgot to clock one break. If they have you on camera, then they'd be able to see when you left to when you got back. Hopefully this gets your job back. What they did and how they handled it was wrong.

Note: if you get your job back, be prepared for them to make your life hell while you work there. I've seen it happen. One time
They transferred a co-worker to another store because my old manager had a major fit when he found out the person he wrongfully terminated got their job back.

The real reason why you were terminated is because you left the premises while on break. Even though you were on break Kroger is still liable for your injuries if you was to get in a car accident, because it is a paid break.

What you should had done is notify a comanager and clock out as a lunch. Also regardless of you using the restrooms multiple times they can't do anything about that as well.

And I got a dick hung down to China, why should you believe me? Because I said so! I'm with OP on this, it was bull sh!t and management wanted to fuuck him. Plain and simple. 'Go ask a manager'.....pfff, wtf
