Threatened with suspension??
Permalink Closed

So, I have been sick off and on for months and have had to go threw an array of different meds that occassionally cause new symptoms or worsen what I alreafy had.  Every time I have had to call in due to this, I have given an advance notice (at least a day) as well as provided doctor's notes.  Most managers have been aware of my situation and take it in stride, but one (my department's supervisor) hasn't.  They've started, well, threatening to suspend/not schedule me as well as hint at firing me.  Do they have any ground to do this on?  I'm past my probation period and I can't exactly help that I'm having health issues that have warranted not just doctor visits but a few trips to the hospital as well.

I'm not really in a position to lose this job, but I'm not sure if this is a bullying tactic or something to be legit concerned about.

The store managers have to fire you.  The department manager can only suggest it to the store manager.

If you are following the attendance policy, then they can't really do anything except make you miserable.  If it gets bad enough, you can file a complaint with the union and/or the HR department.

If you have open availability:

Generally, most contracts guarantee 12 hours a week for part timers.   If someone with less senority gets scheduled more hours than you, then grieve it asap (before noon Saturday) to claim those hours.  I have heard of some cashiers being scheduled 0 hours but then given hours the next week.  You have to wait a week to file for unemployment.  Not sure if they signed a lay off notice or not.

If you are full time, then some contracts allow you to be forced back to part time.

You should ask your union rep what your options are.  If the shop steward is not helpful, go up the chain of command.

This kinda sh!t is always annoying cuz the posters seem to be 100% on the ME ME ME trip.

You cant help being sick? The business cant help needing people to do the work. That simple.

Hiding behind unions to avoid work is part of whats giving organized labor a bad rap.

OP here.  ****ing excuse me for worrying if I'll be losing my only source of income because I've been battling bad cases of pneumonia that leave me too ****ing weak to leave my bed, let alone to work effectively.  Excuse me for not wanting to spread this **** to my fellow co-workers OR our customers when I have been well enough to move about.  But I guess giving two ****s about the well-being other people doesn't matter since I'm on a "me me me" trip.  I have already gone in to do my shifts sick and have been sent home by the ****ing co-managers because they don't like the idea of me being contagious enough to spread this because the last thing we need is more people calling in sick.

I also don't like your assumption about me "hiding behind unions" to "avoid work" since I said nothing about whether or not I was in a union.  All I said is that I made sure to have a doctor's note for each absence, which is what our store policy is.  I don't like missing work.  I don't like being deemed too sick to work.  But I also dislike being threatened with the loss of my job over something I have no control over.  I posted seeking an answer as to if I could be fired when I have been following store policy regarding the situation or if my supervisor had any grounds to verbally bully me as they have been.  If you cannot actually provide any useful response, then kindly **** off.

To the other anon, thank you for your response.  I'll be checking to see if they schedule me for this upcoming week and if not, then I'll try to have a discussion with one of the store managers regarding this situation.

Take care of yourself first.  I had pneumonia and acute bronchitus and my doctor told me get as much rest as I possibly could.  I kept working.  I used to rush around and was very high energy.  Well, I mentioned to another employee I was going to slow down a bit because I was sick.  That woman went to management and said something (don't know what) but the next day the comanager pulled me from my department and told me she wanted me to help her do the 3:00 scan.  She basically started running down the isles and saying hurry up hurry up we only have 30 minutes.  I told her I can't go that quick. Then she said hurry up we only have 10 minutes left.  I said we haven't been doing this 20 minutes yet, we are only on the fourth isle.  She did it to harass me.  I could hardly breath from running after her.

I eventually quit Kroger for other reasons, but a year and 1/2 later I have one inhaler that cost 360.00 and one that cost 65.00.  I never took the time to get better.  So, get well, then worry about work.  Take it easy if you do work.  Don't let them harass you.

Disability isn't something I can go on for this (nor would I), and I honestly don't like you flippantly using it as there are plenty of people who should/need to be on it but are denied it.  Same with unemployment.

I am among the handful of the best workers for my department (if the constant statistic postings in our break room are anything to go by) and have been told by the managers I talk to when I have had to call-in/get sent home by them that they look forward to when I feel better and can return to what my typical work week is.  So, sorry to pop whatever opinion bubble you have of me, but none of them have given me the impression that they find me unreliable.  If you had bothered to read my opening post, you would see that I stated that I only have ONE supervisor that isn't pleased with this situation and they have resorted to bullying tactics.  All I ****ing wanted to know was if they had any ground for their behavior of threatening me with suspensions and not being scheduled period when I have followed our store's rules and policies regarding being sick and having to call out under doctor's orders.

If you can't be helpful, then you're correct, you are done here.  Go bother someone else with your asinine remarks.

Sometimes you just have to face the fact you aren't in the situation to have this type of job. Go get one where you sit at a desk all day or make your own hours. Can't pay any worse then Kroger...

Talk to your store manager.  We had a girl that ended up in the hospital, unconcious, for 6 weeks.  We took up a collection to help pay her bills.  We really thought she was going to die.  Then came a miracle!  She got out of the hospital but had to go to rehab.  She worked at Kroger around her rehab and the store supported her through all of it.  She has now been promoted to a floor supervisor.  So it's really dependent on the store's view of you.  Try talking to management.  This girl was just a cashier so she could have easily been replaced but they didn't.  Good luck to you, get better.

Wow, anons getting salty in here.

Yes: as long as your absences are excused you should be fine. (Doc note)

No: your supervisor shouldn't be saying those things to you. If you ask them to stop the behavior and they continue threaten THEM with harassment charges.
No: They can't schedule you poorly as you can file a grievance to claim hours/shifts of the people below you, as long as you can do the work.

As this question is now answered I'm just gonna lock up this thread. Good day!
