I posted for the job after left for another company got certified in the position and now i hear hes coming back because his other job fired him. My department head and ast dept head won't give me a straight answer on how its going to work. He was only gone for 4-5 months so he gets to keep his time.
We are a small store our department is dept head, ast dept head, part time cutter, 1 full time meat clerk and 2 part time meat clerks. I posted for the job so i could have the morning hours and more hours but now with him coming back my dept heads keep hinting at him getting some of those hours. Is there anything i can do to protect my position and hours?
If you are full time, most contracts guarantee 36-40 hours. He might keep his seniority(minus 4 to 5 months) but I don't think it means he gets his old position back. You bid for it, you should keep it. He might be able to bump you out of the position but he can't force you back to part time.
Rehiring someone is usually dependent on if there is an opening and if the store manager wants them back at the store.
You need to ask your store Union rep about it. If they are unhelpful, ask your district union rep.
I have never seen this happen so I don't really know how it is going to play out. Post an update if you are able to.
Its a part time cutter position so its not full time. More or less concerned about losing working hours in the morning and being mostly nights again. Part timer seniority doesn't freeze unless your contract is way different than mine.. They start from ground 0. 5 months is a long time to be gone. It might get called experience pay/rank.
You need to speak to the district union rep then. If you disagree with your department manager, then they can make your job difficult. If you don't raise a stink about it, then you will be walked over. Pick battles wisely.
I know the only way I could transfer to another store as a part timer, I would have to quit the store I am at and re apply at the other store starting at minimum wage.
So in the end they did screw me told me today that me and him are going to switch mornings as part time cutters even if theirs only one true part time cutter. Told them i don't agree with someone who quit getting rewarded with the hours he wants back. They told me o well we want another cutter. Walked right upstairs gave my 2 week and my dept head just keeps asking why man i love idiots.
So in the end they did screw me told me today that me and him are going to switch mornings as part time cutters even if theirs only one true part time cutter. At this point its not even worth the fight with the union i would probably end up winning but dealing with them after i win wouldn't be worth the trouble of working at kroger. Since i started fighting them on this they already tweaked my schedule to be annoying. example mon 130pm-9pm tues 7am-330pm wednesday 1230pm-9pm thursday 7am-330pm. night and morning swaps are already been playing hell with me for the last month
