Indefinite suspension

So a friend of mine for caught stealing food from Kroger and maybe it happened like 3 times and the total value of the stuff she stole was under $50. She got call into the manager office last week and they put her on indefinite suspension And ask her to return her work uniforn. They also told her that she could try and call the union to ask them for her job back but I don't think she's in the union. Can she still try to call them and get her job back? and I'm not making excuses for my friend but she been going through a lot of family problems at home lately and her grandpa is dying because  cancer. I feel bad for her. Please help and be honest.

I've always heard that the union represent all employees, whether they pay in or not.  It sounds like your friend is being canned and rightfully so. Regardless, I wish her the best of luck.

Most likely she's done with. There really isn't any excuse for stealing. And she could call but really anyone stealing is done for most likely and if she isn't even s union member she won't be a priority. If she by some chance would get her job back she better be grateful to that union but I really doubt it.

She is cooked.

The union represents all people who are part of the bargaining unit.  This means all people that pay dues or (if in a right to work state) everyone regardless of if they pay or not.

However, what an employer needs to terminate you is "just cause." That means a reasonable reason to justify letting you go.  As long as she knew she was not supposed to steal food (obvious) then the company had just cause to terminate her.

BTW, when they take your stuff and send you home they have no intention of ever bringing you back.  She will get a call in a couple days telling her something like "our investigation is concluded and we have decided to end your employment."

 

My best advice is this. When she gets that call tell her to ask "Instead of being fired, may I resign?"  If she is fast enough, say it before they can terminate her.  She will not be able to get unemployment but it will be easier to get another job if she does not have a termination on her record.

I just told her your advice and she said that when she leave the manager said "I'm sure that they enjoyed having you here and be sure to bring back your work uniform when you come pick up your last check." So do you think she still have the chance to ask to resign when she return her uniform?

 Dang, it seems like they already fired her though!  I thought she said she was suspended?  She needs to clarify is she suspended and being investigated or is she already fired and turning in her stuff?  If they already put it through the computer she is done.  She better get on it and call or go in and ask!!!! Do yall live in a big city or small town? Are there alot of help wanted signs?  She has to get a job quick before anyone knows!

 I'm not so sure, she told me that when they called her up and they told her that it was an indefinite suspension and they had her sign some sort of paper and then the manager put it into the system. But when she was walking out the manager told her to bring back her uniform when she come back to pick up her check. So I have no idea, but she is applying for other jobs she want to know if she should try to resign so the new place would consider her.

 I honestly don't know what was going on in her head when she s the food but she's been going through some rough time with family problems (Ik it's not an excuse or if it would make steal ok) but she also been hanging out with new people lately and they're bad influence and I think one of them steal things so they probably pressured her into being like them

Tell her to go ahead and make the call to the manager that she did her "exit interview with" and the HR manager and fall on their mercy. Ask if it is too late to resign. She is sorry and just wants to be able to get another job. Honesty is the best policy sometimes, but dont say more than is needed.

If it is an indefinite suspension, then she should be able to resign. Don't know if she'll have the black mark follow her, or if a future company would ask why she resigned.

I don't think Kroger would reveal why they were terminated.  Most companies will only say, "They worked for use from this date until this date"  to avoid litigation.  The only way a new company would find out is if they knew someone that knew what happened.

I work with a girl that was terminated for stealing something very petty($3) from a major competitor while working for them.  Kroger isn't aware of it that I know of.  I have never discussed it with her and don't care as long as she does her job.  I found out from the person that had to fire her....

companies can absolutely ask in what way your employment ended. you can use words such as voluntary or involuntary. or resigned in lieu of termination.  There will be no litigation for revealing this.  Going into detail is what gets you into litigation!
