The manager for 3rd shift grocery has been making some people stay past their scheduled shifts saying he can hold them after for 2 hours.

What state are you in?  The rules varies by contract by state,etc.

There should be a copy upstairs near the break room.  Or, one of the old timers will have one somewhere in the store.

You might get lucky and find one online.  Your best option is to call your district union representative and ask them directly.  I would skip the store steward.

I am a Night Grocery Manager.  I am permitted to force my crew to stay over 1 hour past their scheduled shift.  Two hours if it is an emergency.

I must warn them one hour before their scheduled shift ends.  I can usually see if we need to stay over before we start and I tell everyone at the beginning of the shift.

Things seem to get done faster when I do that.

I rarely force anyone to stay.  There are five out of 14 of us that do not mind so the five of us stay over to get things done.

Part timers with set availability are immune to the mandatory overtime.  Make sure it is set in eschedule.  If a part time person is only available until 630, they leave at 630 and I can't do anything about it.

         You can call your Union and ask them for a copy of the contract. They will take it to the store and department you work in and put your name on it. You can also go to the website and login with your union ID card and read it there.

I am full time... what if I am unable to stay past my 8 hours due to my wife works and needs the car, plus I have a 3 year old to watch? I can get in trouble If I leave?

You need to speak with your district union representative.  They will be the person defending you if you are written up.  I have one person in a similar bind as you so I don't force him to stay. 

Generally, a full time here has one consistent day off.  Guaranteed 40 hours with two days off a week.  Has open availability otherwise.

Kroger does not care about your wife or child, its all "the business" now.  Maybe if your more productive they will give you a $7 Shirt and tell you your awesome once.....then tell you to get faster!

I'm in Michigan and after reading the contract that was in the break room I didn't see it mention anywhere that you can be held after at all. Is it possible I just missed it or is the manager just lying the newer employee he was holding after.

that's how it is here. my boss can make us stay an hour OT as long as we get an hour notice, otherwise they can't force you. i have yet to be forced to do 2 over, but I've been offered it. (i always refuse wink)

Definitely speak to your District Union Rep.  I can't find it either.

Page 7, A-3  UFCW 876

Appears OT shall be offered to those with more seniority first(full timers).  If no volunteers, then forced on those with less seniority(part timers). 

I had a store manager call the union and ask about 5 years ago.  She said they said that in an emergency, she can force people to stay over 2 hours.  She did too.  We were short 4 people on  Night crew and she made cashiers stay and set the promo aisle and run Easter stock.

The Day Grocery manager said I can force people to stay over an hour.  I tell everyone 2 hours mandatory OT.  That is my story and I am sticking to it....

I must give everyone a one hour notice before the end of their shift.

         Change your availability on your portal at greatpeople.me. It won't take affect immediately, but if you've worked there for at least a year they should comply!
