Clarification on break times

Probably should have asked this a long time ago. But apparently I thought I was doing it "right" but I guess not.

In regards to taking your 15 min breaks. I know that it says in the handbook that you can't do it until you have been on for 2 hours. Does that mean 2 hours since you clocked in. Or does that mean if you have a 1 to 9 and clock in at say 12:53, you can take your first break at 3?

I ask, because I know recently when I had been closing in deli folks keep asking if I've taken my first break at times. And I'm like dude I can't I just got here(usually when I'm doing 2 to 10) and they start asking me at about 3ish. As I'd normally take it at 5 if I'm doing a 2 to 10. And when I do 1-9's I take it at 4.

I get we typically have a few more people on than in bakery at times. And I know everyone has to get their breaks. But dude, I would think it would be taking one too soon if I took one at say 3 if I was on a 1 to 9 in deli. As I eat and so forth before I come into work. So I don't need something that soon. Not even to sit down really.

In departments other than the front end, you can take your break whenever you want really. The union book may say after 2 hours but sometimes I will take it as early as hour and half after I clocked in depending on if I'm tired and have a lot of work ahead of me and just need to sit down, eat, and prepare for the upcoming battle lol.

There are scheduled break times the DH can print off eSchedule but most stores rarely ever do unless they really, really want to look pretty for a district visit. Other than those times, I never see intended break times posted near schedules in fresh departments.

Well at that rate, I'll stick to 4 for deli closing hours. And I'll bump it up to 3 for bakery. I try to get a early one for bakery anyway. But it's like they keep pulling you back in to fill something else or the customers need to order this or that. And I always end up getting a break later than expected or not at all.

But yea, I'm going to try it at 3 tomorrow as I'll be closing bakery again for a 1-9. As we always have all this dang on bread to slice and the earliest they will let us start on it is 4:30. Which sucks when you have roughly 6 of every flavor out there at one time.

The only specific thing our contract (Louisville Division) says is you can't be made to take your lunch no sooner than 3 hours after the start of your shift and no later than 6 hours after the start of your shift.  That doesn't mean you can't take it before or after those times.  It just means they can't make you take your lunch outside of that time range.  I frequently don't take my lunch until well after the 6 hour mark, but I do it because it's beneficial to me.  I'd rather finish a task than stop it and have to come back to it.  As far as breaks go, the only thing the contract says is breaks should tried to be scheduled close to the middle of the working period or shift.

I don't really think anyone in Management cares when you take a break as long as you have been there a few hours and customers are being taken care of.

True. I was just curious though about it in general. Given how it seems of late peeps keep wanting me to take my first break earlier and earlier for some reason.
