on august 21st 2018 I was arrested for crime that I had did. but I had to stay in jail for about 17 days. they say I volutarly quiet but I didn't they say I didn't call everyday but I did my mom actually did and she had proof of it from my phone company which was metro pcs back  then. can I sue Kroger for doing that to me

Why does everyone feel the need to sue in this country? Take responsibility for your ****-ups. What do you expect them to say? "Oh, you committed a felony? That's alright, we'll save your spot." Get lost.

Um no, if you're arrested and you're in jail that counts as ncns'ing. This happened in one of the past stores i worked in, one guy didn't show up for a few days and we found out he was in jail. They term'd him.

There isn't JAIL leave....lol Even calling off daily would not have changed the outcome. The only valid reason after calling off for a few days is a medical or extreme family situation. Its been 1.5 years since this occurred, can you not find another job? OH....wait you have something on your record.....

Every state has legal laws for this. If you are a no show for three days technically job = bye bye unless you have a valid excuse or medical excuse with the paper work to prove it. You're not the first coworker in a company I've worked for who's been fired due to jail time. You obviously missed the deadline for union grievance which is what you should of done. Each contract is different but mine is 15 days from termination date or 60 (?) days depending upon the offence. You can always talk to an employment lawyer that specializes in this sort of thing. Try to find a lawyer that doesn't charge for office visits. Anything more than a year old you might be hard pressed to get justice for unless it's a serious offence.

You haven't found a job in 1.5 years? Wow. Suck it up and accept any thing even if it't work at Target. Under paid is better than no pay and being poor. Post your resume online and base it on career skills not employment history. I do it all the time because my prior work had me all over the place for employers. For contract work it looks better to say I've been doing --- for 7+ years rather than I worked here for three months there for 12 here for four weeks... no work for the summer but volunteered.. here for eight weeks... Get the picture? Have you ever thought about the job retraining program? I'd look into it. It's free.Every state should have one.

I'm pretty sure the handbook at Atlanta division says incarceration is not an excused absence

OH, I forgot to address in my original post.......a LAWSUIT it not a course of action for all things. If you were incarcerated for something that you didn't commit and were acquitted, you might have some standing in requesting your job back. If these occurrence, most business/employers understand this were actions outside of your control and look at your past job performance. If you were found guilty and admitted to committing a crime that caused your job abandonment, hopefully the job market is better after you get out of the slammer.
