are breaks paid or lunch? I currently don't take lunch and am working 7 1 / 2 scheduled and punching out 2 15 minute breaks am i getting paid right?
You get paid for 15 min breaks yes. I never clock out though when I take 15's. hour lunches are not paid. lol just make sure you punched back in from a 15
Breaks are paid. Lunches are not paid. Some stores require punching for breaks others do not. If your pay check is deducted break pay contact your union. They just want to make sure people take no more than 10-15 min and not abuse the break privilege. I know a lot of coworkers who abuse the break privilege and go take a smoke every couple hours and disappear from post for 20 minutes. Or will some how turn a 10 min break into a 30 by dragging their feet in various ways.
Your lunch can be as early as three hours in but no later than five hours in according to u.s. labor laws. The company can get finned every time an employee chooses to skip or be neglected a lunch.
For every 8 hrs you get 10 minutes on each side. If your lunch is set up to be three hours in you still get two tens. Period. Regardless on which side of your lunch they fall on.
If you have more than three hours between lunch and break you get two tens. Two hours minimum.
If you have a 5+ hr shift you get one ten min break, one lunch.
A 5 hr shift = one 15 min break.
A 4 hr shift - one 10 min break.
If you are scheduled a 10 hr shift you get one ten every three hours or one fifteen every five. Your lunch will be 1 hr. So yes you might get like three 10's but it's legal.
If your shift is 7.5 hrs you still get two tens and one 30 min lunch. It depends on how your lunch is set up too. If you have three hours - lunch - four hours = 2 ten's. If you have two hours lunch = 1 fifteen. If you have 2.5 hrs lunch you still get two 10's.
Your lunch does not count as your break. My last store was denying workers their ten and claiming their lunch 2.5 hrs into their 5 hr shift was their break for a 5.5 hr shift. Legally no. They are separate entities.
