Coworker keeps going out on medical leave. Getting old. It's been going on 3+ years and isn't getting better any time soon.

One of our staff members keeps going out on medical leave and refuses to step down to part time. His/her ongoing medical issues cause him/her to miss more than 70% of their shifts. They have been written up twice already for attendance. Then finally got it diagnosed. Unfortunately due to medical laws protecting them we have to sit and deal with the shortness of their absenteeism. Management refuses to bring in a back up assist when they go on leave. Their medical issues are making them grouchy as heck and it's getting old dealing with this negativity on a regular basis. It's getting to the point where they're scheduled full time but barely show up for enough hrs to even get health insurance. This game of dragging out employment is getting old. Due to medical laws they can't just fire them. 

Personally I can't handle full time but they keep making me work full time. I told them I'm doing 2 classes a quarter (online) and can't afford to fail them because of you. I use to have 2 days a week off and evening shifts to allow more study time but now they're not even honoring that. I am putting my foot down about 3 days a week off.

To make it worse when ever we get weather events he milks the call out privileges until they warn him/her come back to work in 72 hrs or be written up for attendance. 

The union is protecting them due to their longevity of 20+ years with the  company. I hate to say it but if their longevity is protecting them that's total b.s. 

They know our store manager doesn't care nor give a sh-it so they really push the system to the extreme. 

Some of the stuff this individual  gets away with is insane. Has his karma caught up to him yet? No. 

 

If this individual were in a real job they'd of been fired multiple times over and over again. They would fail to survive in the real world. Management isn't going to replace them until they quit, retire or their health makes it so they can't.

Sounds like either you find another job or count on staying miserable, cuz you said it yourself: management aint gon do nothin about it.

Put your availability in online and stick to it.  When they break it, call the union.  Over and over.  Every week.  Every day.  Every hour.  Some idiot nephew new hire will eventually pick up the phone by accident.  Eventually. 

They won't be able to help you in any way.  In fact, they will refuse to.  You will be as infuriated as you are helpless, which is to say, completely.  But you will learn a valuable lesson about the nature of unions in America.

Kroger will only dick you as deep as the union lets them.  Which is to say, they will knock out your teeth from behind.

Worst case scenario, you could make more than your current manager even if you apply to Del Taco.

Yep, bout accurate. I work for a factory these days and we have a union, but they're as useless as a cum stain. Near as I can tell all today's unions are good for is taking your money and not doing a damn thing for you. What ever 'benefits we've negotiated for you' are nothing but crumbs the company didn't a sh!t about 'giving' you. The whole solidarity thing is an illusion that keeps people showing up to work, that's all.

Like I said already, best just find a new line of work. Covid Culture has actually vreated a whole new job scape with pretty kick ass pay and benefits. NOW is the time to take advantage of it!
