when we scheduled our vacations at the beginning of the year, one of our dept backups picked the same week as me.  I have 20+ years, she only has 5yrs.  Does she get it because she is a manager or do i get it because of seniority?  I've been told both ways.

I've been with Kroger for over 35 years. Vacations go by either hire date and seniority. I know the vacation rosters at my store always list the names in order by date of hire with the person who's been there the longest at the top and the most recently hired person at the bottom. I'm at the top of the list in my department. So even though I report to a department manager and a back up, I still get my choice of what vacation weeks I want before they do. The only real perk of being a department head is the higher wage. Everything else comes down seniority. If it were me, I would pick another week if and only if my department manager had a trip planned and I didn't have anything planned that particular week. Otherwise, she's going have to pick another week or they'll have to let both of you go at the same time.

One more thing, the issue with vacation scheduling should have been resolved back when the vacations were approved.  Either way, if you really want that week, they have to give it to you.  Otherwise, it's breach of contract.  My contract says under General Vacation Provisions" "Vacations shall be made by seniority within the store."  Yours probably says the same thing or something similar.
