Here is my story, Been crunch with time and the managers telling you no over time. I rushed to do markdowns in the yogurt section and found the first two cases of the Yoplait key lime,lemon and light black berry shortdated.
Key lime (exp Jan 10), lemon (Jan 8) and black berry (jan 7). well each of the flavor had a total of three respective cases. I made the mistake to assume that the back cases where the same date if not very close to the same date as the front cases. Technically this would be the case under proper rotation. So i proceeded to markdown everything the two fronts and the back. Well to my surprise the back case of the lemon and key lime where outdated.
Well I was suspended pending investigation b/c i had markdowns outdated cases with the intend to decieve customers when in reality it was just an honest mistake. Why would anyone markdown expiered yogurts on purpose?
I was suspended with no write-up or anything but my back up it seems he was let go with a slap in the hand. Is this fair? He used to be the dairy lead until I came along. What do you guy advise in this situtation. It was an honest careless mistake. Grocery has baskets of outdated items pulled from our shelves when they are at our stores. Isnt that decieving within it self? Any advice would be nice

suspended pending an investigation usually means your done.
If you told managment it was an honest mistake and no customers purchased the OOD product, Then I dont even see a SIR report for that.
Our Dairy has atleast a half a basketcart load of OOD's at any given time with dates has far out as 3 months. I overflow a basketcart of OOD product and take a photo for record and send an email to store managment and the lead dairy clerk might get a SIR report at most. (no I dont work in dairy, I am a produce manager), I pull dates ervery now in then for the sake of our customers.
So a suspension is a little extreme. This is the time to get union involved, tell them the truth and explain what happend. You should have a few SIR reports before they put you on suspension. Also if theres no proof, ie: photos, paper trail, customer returns for OOD product then I see it being droped.
This incident seems like it was taken to the extreme by members of store management. My question is, how was store management made aware of the markdown mistake?
Store manager where made aware of the markdown incident because and employee both ,i believe was, three units of the key lime, which where unfournatetly markdown but outdated. Like i stated above been under pressure to finish everything on time I made the honest mistake of marking down everything assuiming everything was shortdated not out dated. The funny thing about all this was that the store manager had told me that my back up and myself where going to recieved a write up.
Then the next time i went back to work she didnt even suspend me unitl i had finish working the dairy department. Is this even right can he/she do that? I tought a suspension was asap. Then she gave me the excuse to saying that she had to call labor relation to get advise on how to properly write me up based on this. Thats a little weird isnt?Then I heard bla bla bla.
I kept myself to saying the minimum till i talk to my union to explain them what happe.
P.s. if the store mananger send people on the clock to go buy coffee isnt that automatically suspension? I found that out aswell that store management does that. For whatever reason I was told that my back up pin everything on me. Which was more on an excuse to get suspended. If hes not authorize to work in the the U.S. what to do? I normally dont get into that I mind my own business but hes tryiing to get ahead by throwing people under the bus. I dont play those games.
Also forgot i have only been given one write up in my six years with the company. At that time i believe like 90 percent of the store received one for been tardy. this was about three years ago..just throwing that out there. What do you guys think my situation is and its probable outcome?
Hamg in there! Sounds like an honest mistake and rotation problem. I think you would have a good case with the union to back you. Sounds strange that they had you work all day before suspending and that wouldnt give you a verbal warning 1st. What has happened to warnings and a write up 1st?
Check your employee handbook. If you don't have one, ask for one. They are suppose to follow certain disciplinary guidelines before suspending someone.
1. verbal warning
2. written warning
3. 3 day suspension
If they didn't follow the proper guidelines, then you need to file a grievance.
At our store all you need to do is say union and management is a_ _ kissing! The people who yell the loudest act like bigfat jerks get by with sitting on their a- - AND GET IN NO TROUBLE! TRY THIS
