I got "fired" (suspended indefinitely) for not showing up to work. I was on vacation and apparently they pulled it last minute. I got tons of calls in which I ignored, because I was on vacation. I mean what the hell?!? I'm not with the union so I doubt they can do anything. I called human resource and they said "we can't really do much." I responded with,"you mean you won't do much." They hung up on me.
I know now they screwed up chances of me getting unemployment. I wonder if I should leak out sensitive info about the company I overheared as retaliation. That would REALLY screw the store I was at over. What can they do? basically gone. They can't fire me.
They can and will sue you. They have tons of jew lawyers with nothing to do. The union will still rep you even tho you arent in it. or Go apply at walmart.
You should file a grievance with the union. I think they should defend you even tho you don't pay dues. If you signed the write up, then maybe not. Everyone benefits from the union contract whether they pay dues or not. If Kroger broke contract rules, the union should defend the rules of the contract.

Basically, at most stores, your vacation is scheduled at the beginning of the year. You gave them a date and they approved it. No one can force you to cancel it. You have to agree to changing your vacation. They need your permission.
If you didn't agree with the change, then file for unemployment. You were terminated for faulty cause. They might give you unemployment.
Why wouldn't you answer your phone if your job called you on vacation? It's obviously very important. You could just say that you are on your scheduled vacation. And then see what happens. Not wait a week.
OP here. Because I was on vacation. I DO NOT like being bothered on my vacation, they should have planned ahead. I've made copies of my schedule/vacation time. Hopefully that trumps whatever they do. I want my job back... If i do get it I want a transfer. Management at our store tends to be VERY vengeful. I'm looking into this fully. Being fired for not answering the phone for whatever stupid reason whilst on vacation is pure and utter f*cking bullsh*t !
It is nice to have principals. But sometimes you have to suck it up. It is not worth it to now not have a job and benefits, sometimes you just suck it up and give kroger a pass. Steal some food to make yourself a man again.
I ALWAYS ignore calls from Kroger whilst on vacation. Yes, they ARE REQUIRED to give you the day(s) back if they call you in and IF you decide to come in on your vacation....but waiting until "needs of business" pass before getting dates back is NEVER worth it. I've had friends answer the phone during repeated calls (20+ calls) to tell them to leave the the hell alone and that I am busy. I caught 9 flavors of hell when I got back, but nothing came of it. They cannot fire me for having a friend answer the phone, anymore than

The only rule is if he's management. Then you ARE REQUIRED to come back and retake the days when feasible.

OP you say you weren't in the union, yet you had a vacation. Can you or someone please explain how that works? I don't recall having the option to opt out of the union. You'd have to be there at least a year to get a vacation I would think as well
Not every state requires employees to join the union. Here in Georgia it is voluntary (Right to Work State). Also you don't have to be in the union to get a vacation, just have 1 year of service. OP never stated the years of service they had, so your question is baffling.

I figured he had to be there a year before he got a vacation, but didn't know that not all states required you to join the union. If they did require it, and he wasn't in it, it wouldn't make sense that he'd have vacation time (ie, he'd be a new hire who hasn't joined union yet). Glad you cleared that up about R2W states
Another thought. What if OP is a co-manager? This is something he didn't state. If he's co-manager of a store then he is not union. He's salary based. Therefore is REQUIRED to stop his vacation and come in when needed. That's the only reason I can think that they fired him.
