Should I have went to the union?

The period of being able to report this has passed, I was afraid to post it because it's kind of detailed and i didn't want to be identified, but I want advice on this situation as it could happen to me again, and i want to be prepared.

I transferred from the worst store in the state, to a training store. Our Store Manager changed right after the old one had hired me, as he got promoted, and we got a brand *new* store manager. My mother, whom I live with, has very serious medical problems. She is fine mostly, as long as her oxygen doesn't drop. One day it was as low as like, a 72 or something, I can't remember exactly. She had went to the doctor that morning where they made her stay to try to get it up a little, and was told to come home and put her oxygen on immediately. I was up all night the night before (0 sleep) because I was worried about her not feeling well. Then, drove her to the doctor, then drove home.

I sent a text to my manager at 5AM describing what was happening, and was told later that morning that I needed to call the store.. as I couldn't really call the store, I e-mailed the store manager, who told me later to talk to my supervisor. I ended up falling asleep in the living room, on the couch next to my mother.. we both were exhausted, so work didn't hear from me for a few hours. I told them I fell asleep and I'd be there, whatever, I wanted to stay with my mom but they were going to be hard asses about this so **** it. 

When I went in, my CSM had tried to work out with my closest friend how we can change the hours, me and my friend were both full time, and the store manager would have to approve OT for it, like 30 minutes. He refused. My friend came to my house to tell me that and tell me she was sorry, and I was crying. (I have major anxiety, especially when my mom has health issues, that is known and VERY important to this story)

I go in, I have a closing shift, and I'm obviously still upset and kind of pissed off. My FEM says I can leave at 7PM once someone else gets here that can do my role, if I can convince a bagger to stay until 10PM for me, which I knew he would seeing as he's a good friend of mine. At 5PM, as the store manager is leaving for the day and another co-manager comes downstairs with him, they stand around my area talking, and a friend comes and takes my post. "What's going on?" "I'm taking over for you, for a second" and then I know what's about to go down. 

They're standing right in front of the bathroom doors (in the front of the store), behind the OTC stands, right beside UScan (my post), out in the open. They start literally interrogating me about my mother's health. This happens right during a 5 o' clock rush, everyone can see us. I tell them the situation, and the SM asks why she isn't in the ER. (She went to the ER many times for this and was put on a ventilator until her oxygen came back up, and she really didnt want to go through that again unless she had too). I told them this and the first thing my SM says is "A ventilator is for life support, like people that are dying, I don't think she'd be put on a ventilator" 

I was frustrated and said "ok, a breathing machine, whatever.." and they keep interrogating me, eventually saying "If your mothers health was so bad, I don't understand why you fell asleep... how are you helping or watching her when you're asleep?" 

This is when I got upset, and I told them I was literally right next to her in the same room on a couch adjacent to her.. and she went to sleep too. They still didn't understand if her situation was so dire, why I fell asleep (maybe having 0 sleep and stressed as ****, maybe?) 

Anyway, they start saying I've missed a ton of work (I've missed 1 day since coming to the store Last December) and that I might "lose my status". I tell them I haven't MISSED work, I've switched shifts, I've always maintained my hours constantly, and I knew I wasn't even close to losing my status but even if I was, my mom is more important. 

(I later looked and haven't had below 37 hours since I originally started at this new store, my CSM wanted to make me full time so gave me the hours since I started there) 

I started losing it as I told them maybe my priorities haven't been right before, but, my mother is all I have and she is priority #1. At this point, saying it make smy anxiety and panic creep up, and I start crying and hyperventilating (so embarrassing, I had to stop talking to them and take deep breaths just to be able to finish my sentence to them) and kept saying sorry... 

In the end, they said they "just didn't want anymore surprises" (aka: have to find other people to cover because they refuse to have to find coverage for someone else who calls out/sick/etc).

This happened all on the sales floor, in the front, in front of OTC medications.. the whole staff could see me and the managers, the customers at UScan could HEAR and see us, I was so embarrassed). I later told the other one (not the SM) that I have major anxiety and I felt like that situation was handled wrong.. everyone is aware of my anxiety as it has came out at work before.

She then told me they thought it would be a quick talk, and didn't think it would get that emotional.. My CSM was on vacation the week this happened, and she has told me "if anyone EVER punishes you on the floor, you come to me and tell ME about it ASAP) So I told her about it and I have a sneaking suspicion that they did this because my CSM was on vacation.. they could get away with it. My CSM is a very good one, won CSM of the year, has helped me get full time, has helped me find coverage for days I need off, has helped me maintain my 40, has trained me personally in things I wanted to do and still does to this day.. she's a great CSM, really. She wouldn't have let that **** happened on the floor, she always takes us into a room to give us a talk or outside away from everyone else. 

I wanted to go to the union and knew the SM could get in tons of trouble for it, seeing especially as he is a new SM and came from the front end originally and wasn't a hired in degree holder. But I let it slide, for some reason, I didn't want to make waves or become a "problem employee" Should I have went to the union immediately over this? Would I have had a case at all?

That's not the kind of conversation that should happen on the floor or without a union memeber or shop steward present. I would contact your union rep just to get their view point

I wouldn't of answered all their questions, especially with out a Union Rep there. Yo have no need to explain yourself to them. I would ask a few co-workers if they witnessed the event, then talk to the Union. Next time you're in that situation call the Union and make sure a Union Rep is available to witness your conversation.

This is what I suggest you do! Since this is a Health Related Family Situation, you most likely would qualify for FMLA (Family Medical Leave Act). FMLA is used to take time off for your health or a family members medical issues if your their support. This leave could be for months, weeks or days depending on the situation and what your doctor suggest is the appropriate time frame. I would still let your Union Rep know what has happen, they can at least make a comment to your Store Manager.

I agree you should have called the union.  You should have said immediately or a few minutes in "I demand a union representative."  There and then the have to honor it or the company gets in trouble.  Though if they keep asking questions and you keep replying you void your wine garten rights.
