this is the second time (due to a customer complaint that never actually happened) and they just called me back yesterday to work tomorrow, but it feels fishy because its not a normal shift they usually schedule for anyone out there in fuel. but before they I work they want me to go to the managers office to sign something. I have a weird and bad feeling about this though it feels like a trap to get me in to sign termination papers.
I'll say there's something fishy going on. I'm just not sure where. In the first place, they can't suspend you over a customer complaint. If that were true, we'd all be suspended. Second, they can't call you into the managers' office for disciplanary procedure without a union representaive being present. If the union steward is unavailable, go to the meeting, but SAY NOTHING. Don't even nod or shake your head. Tell them you're invoking your Weingarten Rights. Third, NEVER SIGN ANYTHING THEY PUT IN FRONT OF YOU. By signing what they hand you, you're admitting your guilt. Anything you sign can and will be used against you.
Just tell them, that before you sign, you are requesting Union Representstion because you feel that disciplinary action will result if you sign anything. Use your Weingarden Rights. And if they refuse saying it's not necessary, then just say that "it wont be necessary for me to sign anything uh unless I have a Union Rep present."

Generally speaking this is good advice for any job, union or not. Say nothing . Sign nothing. When you first come in and they tell you to sit, stay standing. All these things throw them off their game a bit, and puts some power in your corner.
One of the sweetest stories I ever saw in the news was the one where a Walmart truck unloader was called in to be fired...only he pulled a gun a did some firing of his own . Two guys and a chick were the managers. He killed one of the guys outright and permanantly wounded the other, although he told the chick 'this is your lucky day, I dont hurt women' and let her go.
Pretty harsh that I'd enjoy this, but I worked for many years for that wretched company and I know how their managers are. Any way. Best of luck to you. Let us know how it turns out.
Did they simply send you home after the complaint? I don't think they can suspend you for X days and then call you back in for a termination for the same complaint. In reality, if they are calling you back in to terminate you, they should have already have planned for a Union Member/Rep. to be there. Also, everyone gets a complaint here and there, its the nature of working with the general public. Also, with customer complaints always have the Union Rep. ask for written proof of complaint, including time, date, customer, and situation. Hell, unless an associate got physically violent, or a complete streaming match where the associate crossed a line of dialog, most complaints are just a "coaching" moment.
