fake violin playing at Kroger parking lot

Can the cops break this up or is it still legal and up to the Kroger patrons to ask if they're really playing and ... in a financial hardship ... before making a donation?  I got a gut feel it can't be stopped based on a legal technicality.  Can Kroger management go outside and kick them out of their parking lot?

We have had this problem here in the Atlanta GA area. Surrounding merchants near my old store #431 complained about the music and customers complaining about being solicited for money. The store in Marietta on Powder Springs Road had the same issue too.

Cops can't and/or won't break it up?  Cops can't ask them to play a few bars without the soundtrack running?  If they fail that test, take them down to the station and book them?

I know wooden violins are temperature sensitive as far as up north performances.  Not sure how that works with a metal violin with the tightening or loosening of the strings.  I guess if they don't warm up first with a simple b-flat concert scale that would be a strong indicator they aren't playing.

They don't actually play songs.  It's just chord progressions.  Ask them to play a simple song like Ode to Joy and they won't be able to do it.  They probably can't even play Do Re Mi.

We have a guy that comes to our lot to play his violin. Doesn't ask for donations, just plays. It's not fake playing as the police saw him set up and tune his violin. He stays out of the way and doesn't bug customers.

People stop and actually listen to this guy. He does it to make people happy.

He also told one guy who told him he needs to leave that if he didn't like the music, walk away and shop elsewhere or deal with it.

Guy was do pissed off he stormed off mad. To damn bad, shop elsewhere, we DO NOT need, or want your business.

It's sad that people are so unhappy in life they TRY and ruin it for others. Then get pissed off and offended when no one does as they say.

They can be formally trespassed from the property if security or management cares to.

I need to chit-chat with an off-duty cop at my gym about this to get the scoop.  I bet it isn't feasible to pursue fake pan handlers from both a cop and retail store management perspective.  I bet there are wacky female shoppers after being told of this scam will respond with "who am I to judge?" and will continue to look the other way, and get this... will continue to donate to them even when they know it's fake.
